Terms of Service – HypeScent

  1. Binding Agreement
    By accessing this website, placing an order, or completing a purchase with HypeScent, you enter into a legally binding agreement and agree to be bound by these Terms of Service, our Refund Policy, Shipping Policy, and all other policies published on this website.
    If you do not fully agree to these terms, you must not place an order.

  2. Made-to-Order Products
    All HypeScent products are made to order and begin production only after payment has been successfully processed.
    By purchasing, the customer acknowledges that products are not pre-stocked, are not mass-produced, and require preparation time.

  3. Accepted Production Waiting Period
    By completing a purchase, the customer explicitly agrees to allow a production waiting period of up to 2–3 weeks.
    This period:

  • is not a delivery guarantee,

  • is not a delay,

  • cannot be used as grounds for a refund, dispute, or chargeback.
    The customer acknowledges that production may be completed sooner, but voluntarily accepts the maximum waiting period at checkout.

  1. Accepted Shipping Waiting Period
    Once an order has been shipped, the customer explicitly agrees to allow a shipping waiting period of up to 2–3 weeks.
    This period:

  • is a contractually accepted timeframe,

  • is independent of carrier speed,

  • is not valid grounds for payment reversal.
    The customer understands that shipping may be faster but agrees in advance to the maximum waiting period.

  1. Waiver of Chargebacks for Waiting Time
    By placing an order, the customer waives any right to initiate a chargeback, payment dispute, or bank claim based solely on production time, shipping time, or waiting periods within the accepted maximums.
    Attempting to reverse payment for these reasons constitutes a breach of contract.

  2. No Refunds After Shipment
    Once an order has been shipped, all sales are final.
    No refunds, cancellations, or reversals will be granted for:

  • shipping delays,

  • carrier issues,

  • customs clearance,

  • or any external circumstances beyond HypeScent’s control.

  1. Proof Requirement for Damaged or Missing Items
    Claims for damaged or missing items will only be considered if submitted within 48 hours of delivery and accompanied by clear photographic or video evidence of:

  • the product,

  • internal packaging,

  • external packaging.
    Claims submitted without sufficient proof will be automatically denied.

  1. Final Sale & Hygiene Policy
    Due to the personal and hygienic nature of our products, all items are final sale and non-returnable once shipped.
    All products are made with inspired scents only and are not affiliated with, endorsed by, or identical to any designer or luxury brand. Individual perception of scent, strength, similarity, and longevity may differ due to factors such as body chemistry, environment, and personal preference. These differences do not constitute a defect and are therefore non-refundable.
    By purchasing, the customer acknowledges and accepts that fragrance experiences are subjective and may vary.
    No exceptions.

  2. Customer Responsibility and Assumption of Risk
    The customer is solely responsible for:

  • providing accurate shipping and billing information,

  • ensuring correct address details,

  • proper use of the product.
    All products are used at the customer’s own risk. Individual reactions, sensitivities, or dissatisfaction do not constitute product defects.

  1. Limitation of Liability
    To the maximum extent permitted by law, HypeScent shall not be liable for:

  • indirect, incidental, special, or consequential damages,

  • personal dissatisfaction,

  • loss of income, data, or business,

  • delays beyond our control.
    Liability, if any, shall never exceed the amount paid for the product.

  1. Disputes, Fraud, and Abuse
    Any chargeback, dispute, or payment reversal initiated without first contacting HypeScent support constitutes abuse of the payment system.
    HypeScent reserves the right to:

  • contest disputes using these Terms as legal evidence,

  • permanently ban customers involved in abusive chargebacks,

  • share transaction records with payment processors and financial institutions.

  1. Intellectual Property
    All content, branding, images, text, designs, and materials on this website are the exclusive property of HypeScent. Unauthorized use is strictly prohibited.

  2. Governing Law and Jurisdiction
    These Terms are governed by and construed in accordance with the laws of the jurisdiction in which HypeScent operates, without regard to conflict of law principles.

  3. Modifications to Terms
    HypeScent reserves the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.
